(doing business as Made) uses terms that have been defined in our Terms of Use document. You can find the Terms of Use document by clicking on this link. This policy explains what information Made collects, how we use and share it, how long we keep it, and how you can delete it. We may change this privacy policy from time to time. If we make a significant and material change, the last update date as shown near the top of this page will be revised. You should check back regularly to keep current with our policies. By continuing to use Made's services, after changes to this policy go into effect, you agree to be bound by any of the revised policy(ies). ## Non-Personal Information This is information about you or your household that cannot be used, and is not stored, in a way that can identify you, personally. We will analyze non-personal usage information of the website services using Google Analytics. Please see their latest privacy policy for information they collect. If you choose submit photo results to us, we will use those only to improve our services. These user submissions constitute consent to use your photo results to evaluate effectiveness and correctness of features, analyze trends, improve existing features and develop new features designed to enhance your overall user experience. Incidentally, some Sensitive Personal Information may be inadvertently collected as a result of your voluntary submission of user image(s). Reasonable precautions will be taken to safeguard these user submissions and their content from further disclosure to non-affiliated persons or entities and will not be used publicly for marketing purposes. ## Personal Information Personal information includes account details such as your name, email address and sign-in identifiers, as well as media and prompts that you upload or create when they can be linked to your account. If we combine personal and other information, we treat the combined information as personal information. When you create an account, we collect the details needed to sign you in and provide the Services. If you upload images, video or audio, or generate results, Made stores those files and related generation records in your account so you can view, reuse and delete them. The files are not automatically removed when a generation finishes. We do not intentionally ask you to provide sensitive details such as racial or ethnic origin, political opinions, religious beliefs, health information or sexual life. Content you choose to upload may nevertheless contain sensitive information. Made does not access your entire calendar, address book, call or message history, or device media library; it receives only files you choose to upload or share with a Made feature. We share information with service providers that help us operate Made, including cloud storage, analytics, payment, and AI model providers. To complete a generation, we send the prompt and any media you choose for that request to the selected model provider for processing. We do not sell your uploaded media. Provider processing and retention may be governed by that provider's own terms and privacy policy. ## Media Retention and Deletion Made keeps your account uploads and generated results until you delete a supported library item or delete your Made account. You can delete supported library items from your account; to remove all Made-controlled uploads and generated media, request account deletion in account settings. This includes media used through the Made ChatGPT plugin. An in-progress generation must finish before account deletion can complete; if deletion fails, your account remains available so you can retry. We may retain billing and transaction records as required for financial, tax, fraud-prevention or legal obligations. Third-party model providers may retain data they processed under their own policies; deleting media from Made does not by itself delete copies held by those providers. ## Laws Governing Data Made is based in the United States. U.S. law and the General Data Protection Regulations of the European Union and the equivalent rules of the United Kingdom and Switzerland, as applicable, govern the information collected. By using the App and providing us personal data, you agree to the processing and transfer of information in and to the U.S. and other countries for the purposes stated in the Terms of Use and Privacy Policy. ## Disclosure of Information We reserve the right to access, use, preserve, transfer or disclose, at any time without notice to you, any information (including Personal Information) as reasonably necessary to: Comply with any applicable law, regulation, subpoena or legal process, or respond to any governmental requests and cooperate with law enforcement, if we believe such action is required or permitted by law; Enforce our Terms of Use, including investigating any potential violations; Protect the safety, integrity, rights or security of our users, the App or equipment, or any third party; or Detect, prevent or otherwise address fraud, security or technical issues related to Made or our business affiliates. ## Meta (Facebook and Instagram) Ad Accounts If you connect a Meta ad account in Made Ads, Meta gives Made an access token with the permissions you approve. Made uses it to read your ad accounts, campaigns, ad sets, ads and their performance, and the Facebook Pages your ad accounts can advertise from, so it can show your reports in Made Ads. When you ask, Made also uploads a video you made with Made to your ad account and creates an ad in the ad set you choose. Ads Made creates are always paused: nothing runs or spends until you turn it on in Meta Ads Manager. Made stores your Meta account's ID and name, the ad accounts your login can see and which ones you imported, and the access token, which is encrypted. Reports are read from Meta when you open them and are not stored. Made does not sell this information or use it to advertise to you. To delete it, disconnect Meta in Made Ads (Connections, then Disconnect), or remove Made in your Facebook settings under Business integrations. Either one deletes the token and the ad account list. [How to delete your Made Ads data from Meta](https://www.made.app/data-deletion). ## Security of Information Made takes precautions – including administrative, technical, and physical measures – to safeguard your Personal Information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration and destruction. ## Children Made's services are not available to anyone under sixteen years of age. We do not knowingly collect personal information from anyone under sixteen. If you are sixteen or seventeen, you may use the services only with the consent of a parent or legal guardian. ## Your California Privacy Rights California law under Civil Code Section 1798.83 allows California residents to request information regarding their personal information used by third parties for marketing purposes once during the calendar year.
